A federal magistrate judge who dispenses justice in Yosemite National Park's tiny, picturesque courthouse received an unusual rebuff Tuesday from one of his big-city bosses. U.S. District Judge Oliver W. Wanger in Fresno tossed out a guilty verdict handed down in fall 2007 by William M. Wunderlich. The reason: A hangman's noose that was on display in Wunderlich's chambers.

What puzzles me about this issue is that the noose was in the judge's chambers. This usually refers to the "backoffice" of the court that is outside the public view and often personalized by certain personal items like moose heads or golf trophies. It is hard to understand how something in chambers could be construed to influence a courtroom decision. If a judge has a hamburger in chambers, will he then not be able to provide justice to someone with a vegetarian lifestyle? I would have some sympathy if the noose was in the courtroom, but chambers seems a stretch.

The odd part is that if I picture a hangman's noose in use, there aren't any American Indians in it...the stereotype is wild west outlaws (cowboy-type) or maybe the famous photo of Lincoln's asassin being hanged. What has old Wanker been watching? (oh, did I misspell his name...never mind, it's a better fit anyway 8^).

The old movies, at least, would have led one to think, were I foolish enough to use Wanker's reasoning, that guns are a symbol of racial hatred, since they were used against the American Indians. Uh-oh, here comes Vince...8^)

Just from my perspective.

When I first heard that the Yosemite judge had a hangman's noose I thought it was kind of funny.

But then I imagined how I would feel if I were being judged by this man. Going to court, I would already be feeling quite intimidated and anxious.

If I then discovered that the judge had a hangman's noose, that would send a message to me. I would feel that he was quick to judge and tended to side with the prosecution. I would also feel that he enjoyed dominating over others and having them squirm under his authority. Whether those assumptions are true or not, I don't know. But that's how I would feel. And I'm white.

By the way, the article says the prosecution has the option to re-try the case (with a different judge).
