NPS claims that since 2011, cancellations no longer go back immediately. The way I saw my reservation being handled at the campground office looked like it had to be done at the campground office. I'd actually called in to say I'd be missing my first day, and I got a call back asking if I would release it for a partial refund. I'm just curious what use it would be to know, since they're no longer automatically released back into "inventory". I recall this was done because scalpers were just cancelling and rebooking immediately when they knew it would be available again. By requiring an operator to release it back into the inventory, the scalpers have no idea when they'll be available again. I've seen a cby y_p_w - Yosemite and the Sierra Nevada. News & Discussion
I don't know how much this really affects the case. If the USPTO board came to a conclusion, either side was likely to just argue that the decision was wrong in court. This seems to really just cut to the chase and allow all this to be argued in court. I'm not sure exactly how they could use it in court if it's sealed. Their contention is that the report is accurate, and the defense would need to be able to refute it. Quoteparklover I agree that getting the trademarks rescinded is a strategic plan. I just hope that this does not drag on for years. The Bracebridge Dinner and Go Climb a Rock trademarks were registered by YP&CC. So far there's no sign of NPS trying to cancel these. They might be trickier since they don't specifically refer to place names. Go Climb a Rock could easily be used as a generic phrase to put on T-shirts, like "Life Is Good".
