I recall this was done because scalpers were just cancelling and rebooking immediately when they knew it would be available again. By requiring an operator to release it back into the inventory, the scalpers have no idea when they'll be available again.

If the USPTO board came to a conclusion, either side was likely to just argue that the decision was wrong in court. This seems to really just cut to the chase and allow all this to be argued in court.
Regardless, if Delaware North wins, the phrase "pyrrhic victory" would seem to apply.

General Discussion I'm not sure exactly how they could use it in court if it's sealed. Their contention is that the report is accurate, and the defense would need to be able to refute it. I guess they might ask for a closed courtroom. Of course the Justice Dept opposes their request.

I agree that getting the trademarks rescinded is a strategic plan. I just hope that this does not drag on for years. One thing I saw this morning on the Aramark website is that the Bracebridge Dinner is again called that and not the Yosemite Yuletime Dinner or what ever it was being called.

Apparently the Interior Dept has petitioned the court handling the lawsuit to postpone it until such time as the USPTO board resolves their petition to cancel the trademarks. Delaware North says it should be the other way around.

They were basically complaining that NPS was erasing their inherent advantage, and that they could have modified their bid.

They've learned. This is an incomplete list of registrations that were abandoned after NPS objected. Right now there's likely someone at NPS assigned to check the USPTO website for names of concessionaires and place names

They might be trickier since they don't specifically refer to place names. Go Climb a Rock could easily be used as a generic phrase to put on T-shirts, like "Life Is Good". I could easily see DNC trying to sell the TM to The North Face or Patago

They even included the registration for "The Ahwahnee" that existed previous to NPS owning the building itself. It's not all the registrations, but probably the most important ones.

Unfortunately, the NPS and the government probably didn't even think about that back then which doesn't surprise me since that is way the government tends to work at times. Well hindsight is better than foresight. However, when Xanterra tried to do this several years ago at the Grand Canyon, that should have been a wake up call to see what other concessionaires were doing this.

It would appear that a compromise has been made - the Jacobs name to be forever associated/ on a Yosemite landmark -
in exchange for $22 million in 1993 dollars...the cost DNC had to pay back then.
If true, seems like a fair resolution?
