There's always the option of going halfway, which is where you get the first (and perhaps, best) view of the waterfall along the trail. You can also do a bit of scrambling to an area near the base. The reward for going all the way up is limited as far as viewing the waterfall goes. Another scenario in which the plaintiff would have a case is if during high waters: a)the ground becomes slippery; b) one of the horizontal bars/rails is missing; c) a person slips into the water as a result. The waterfall is located in India. Earlier this month, there were some people picnicking, having fun in the river not far from the brink. With very little warning, a flash flood occurred. There are quite a few articles on this, and beware of the videos that captured the scene of this unfortunate incident. El Cap from Tamarack or the Valley is quite strenuous, and the views are only so-so. Hiking down from Yosemite Creek Campground would be the way to go. There's not much more the Park can do in terms of signs. The volunteer idea from other threads is a good, plausible one. I think the victims had to be aware that going over the Falls would be fatal, but they probably misjudged the strength of the current and figured they were far enough away from the brink. From my observations, people can be hesitant to speak up in similar (though less dangerous) situations, preferring not to bud into other people's business. Darnit, it's sad to hear stories like this. Unfortunately common sense is sometimes bypassed in Yosemite. It's probably hotter now than in the previous week (when I was there for a day), hot enough to tempt some visitors to cool off in the Merced.
